Welcome to "Where Has This Been?" (the "Service"). We are committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Service. Please read this privacy policy carefully.
1. Information We Collect
We may collect information about you in a variety of ways. The information we may collect via the Service includes:
- User-Provided Information: When you upload an image, we collect the image itself, the city you provide, and the timestamp of your submission. This information is associated with the specific QR Code ID you scanned.
- QR Code Data: We track the history of submissions associated with each unique QR Code ID.
- Device Information (for QR Submission Page): We may attempt to detect if you are using a mobile or tablet device to access the QR code submission page, as this page is intended for mobile use. This is typically done via analyzing the browser's user agent string. We do not collect unique device identifiers for this purpose beyond what is normally available in web server logs.
- Technical Data (Log Files & Cookies):
- Like many websites, we may collect information that your browser sends whenever you visit our Service ("Log Data"). This Log Data may include information such as your computer's Internet Protocol ("IP") address, browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, and other statistics.
- We use cookies to manage client-side cooldowns for QR code submissions. Specifically, if you submit a photo for a QR code, a cookie may be stored in your browser to help enforce a temporary cooldown period for that specific code from your browser. These cookies store a timestamp and are used for the functionality of the game.
2. How We Use Your Information
We use the information we collect in the following ways:
- To operate and maintain the Service (e.g., display your uploaded images and city in the gallery and on the specific QR code's history page).
- To manage the cooldown system for QR code submissions.
- To display the journey and history of individual QR codes.
- To monitor and analyze usage and trends to improve your experience with the Service.
- To enforce our Terms of Service and Posting Rules.
- To detect and prevent fraudulent or unauthorized activity, including ensuring the mobile-only experience for submission pages (unless in a specific testing mode).
3. How We Share Your Information
We do not sell your personal information. We may share information we have collected about you in certain situations:
- Publicly Visible Information: Your uploaded images, the city you provide, and the timestamp of your submission are publicly visible on our Service, associated with the QR code you scanned.
- With Service Providers: We may share your information with third-party vendors, service providers, contractors, or agents who perform services for us or on our behalf and require access to such information to do that work (e.g., image hosting, website hosting, data analytics). These third parties are obligated to protect your information.
- By Law or to Protect Rights: If we believe the release of information about you is necessary to respond to legal process, to investigate or remedy potential violations of our policies, or to protect the rights, property, and safety of others, we may share your information as permitted or required by any applicable law, rule, or regulation.
- Business Transfers: We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
4. Data Retention
We will retain your information (uploaded images, city, timestamp) for as long as it is necessary for the purposes set out in this Privacy Policy, for the continued operation of the public gallery and QR code histories, or as required by law.
5. Cookies and Tracking Technologies
As mentioned, we use cookies primarily for the client-side cooldown functionality. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, some portions of our Service related to upload cooldowns might not function as intended from your browser's perspective (though server-side cooldowns will still apply).
6. Data Security
We use administrative, technical, and physical security measures to help protect your personal information. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse.
7. Children's Privacy
Our Service is not intended for use by children under the age of 13 (or a higher age threshold if applicable in your jurisdiction). We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we will take steps to delete such information.
8. Your Data Rights
Depending on your jurisdiction, you may have certain rights regarding your personal information, such as the right to access, correct, or delete your data. If you have submitted an image and wish to request its removal, please contact us. We will address such requests on a case-by-case basis, subject to our ability to verify the request and the technical feasibility of removal.
Please note that due to the nature of the project (publicly tracking QR codes), complete anonymization or removal of a submission from a tag's "journey" might be complex but will be considered upon valid request.
9. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
10. DMCA
If an image posted to the image board has copyrighted material and you are the rightful owner of the content, you may contact us at [email protected] with the image link and proof of ownership. These cases are evaulated on a case by case basis.
